These Terms of Use (“Terms”) govern your access to and use of the website www.drdecarolisdo.com and any associated pages, content, or features (collectively, the “Site”) operated by De Carolis DO, LLC (“we,” “us,” or “Practice”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Site.
Important Medical Disclaimers
The information on this Site is for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. It does not establish a physician–patient relationship with De Carolis DO, LLC or any of its providers.
A discovery call is not a medical visit and no medical advice is provided during this call.
Telehealth services are provided in accordance with applicable state licensure laws and are available only to patients physically located in Florida at the time of service.
For medical emergencies, please call 911 or seek immediate emergency care. Do not use the Site or any discovery call for urgent or emergency medical needs.
No Physician–Patient Relationship Use of the Site or participation in a discovery call does not create a physician–patient relationship. A physician–patient relationship is formed only after you complete our Patient Intake Packet, are accepted into the practice, and receive confirmation of membership or an appointment.
Permitted Use and User Conduct You may use the Site only for lawful, personal, and non-commercial purposes. You agree not to:
Use the Site for any illegal or unauthorized purpose;
Transmit any harmful code, viruses, or disruptive content;
Attempt to gain unauthorized access to any portion of the Site;
Scrape, copy, or reproduce content without express written permission;
Impersonate any person or entity or misrepresent your affiliation with the Practice.
Intellectual Property All content on the Site, including text, graphics, logos, images, and the “De Carolis DO, LLC” name and monogram, is owned by or licensed to the Practice and protected by U.S. copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, revocable license to view the Site for personal use only. No other rights or licenses are granted.
Links to Third-Party Sites The Site may contain links to third-party websites or resources. We are not responsible for the content, privacy practices, or availability of those sites. Linking to them does not imply endorsement.
Privacy Your privacy is important to us. Please review our Privacy Policy (linked in the footer), which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect information, including any non-protected health information gathered through the Site.
Telehealth and Services Any descriptions of telehealth, house calls, or concierge services on the Site are for informational purposes only. Actual services are provided only after you sign our Patient Intake Packet and are accepted as a member. All clinical care is subject to the terms in that packet, including the HIPAA Notice of Privacy Practices.
Limitation of Liability To the fullest extent permitted by law, De Carolis DO, LLC and its owners, officers, employees, and contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, even if advised of the possibility of such damages. The Site is provided “as is” without any warranties of any kind.
Indemnification You agree to indemnify and hold harmless the Practice from any claims, losses, or damages arising from your violation of these Terms or your use of the Site.
Changes to These Terms We may update these Terms at any time. The new effective date will be posted at the top of this page. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms.
Governing Law These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida.
